Remarkit advises all purchasers should satisfy themselves as to the value of the item being sold. The equipment sale can been viewed in our Warehouse prior to purchasing. This is by appointment only. All units are tested prior to listing. Some items may have slight defects such as scratches to the casing, and/or minor cosmetic defects and/or missing parts. The equipment advertised is normally graded as "Fair". This rating is our highest rating on secondhand equipment. Any defects will normally be noted in descriptions. We advise purchases to consider these comments before purchasing. Remarkit have done their best to provide accurate descriptions. However from time to time human error may occur. In these cases Remarkit will consider any complaint regarding reasonable errors and omissions and will use its discretion in seeking any remedies that may be applicable.

Screen burn is a fairly wide ranging subject with regards LCD panels on monitors and laptops.There are 2 major categories of what is described as screen burn...

1/ Image persistence on LCD monitors is caused by the continuous display of static graphics on the screen for extended periods of time. What this does is cause the LCD crystals to have a memory for their location in order to generate the colors of that graphic. When a different color is then displayed in that location, the color will be off from what it should be and instead have a faint image of what was previously displayed.

Is this permanent, In most cases, no. The crystals do have a natural state and can shift depending on the amount of current used to generate the desired color. As long as these colors do shift periodically, the crystals at that pixel should fluctuate enough such that the image will not be permanently imprinted into the crystals.

2/ Pressure Damage/Bruise A pressure mark is where physical pressure on the screen has led to the layer of crystal being crushed between the two layers of glass that surround it in the screen. This could cause crystals to lose either their liquid or solid properties, meaning they can no longer be manipulated by the computer to act as a filter for the back lighting. This can be seen in mild cases as shadowing, or in more severe instances as white marks, this is a permanent state and unrepairable. 

Can I still use my laptop - YES - both of these phenomena will not affect how you use the device, but a simply one of the possibilities when purchasing a used device.

Terms and Conditions: PUT IT ON LAY-BUY

Layby Terms, agreements and contract

Lay-Buy Financial Solutions Pty Ltd trading as www.lay-buys.com has identified core principles we believe are integral and imperative for all Lay-Buy agreement deals transacted through our PUT IT ON LAY-BUY checkout payment option to be fair and reasonable per the Fair Trading Act 1999.

The following principles below therefore make up the Terms & Conditions for any Lay-Buy or Layby contract and related transactions entered into. This applies to all and any lay-by contract template utilized by both the vendor or consumer:

1. Record of Payment
   A record of payments transaction history will always be available for both the merchant and buyer, recording all amounts paid to-date and the date and value of all future pending payments as per your agreed lay-by policy.
2. Storage and Identification of Lay-Buy Products
   Product’s on Lay-Buy will be set aside and stored separately to other products. Products will be clearly identified as ‘Lay-By contract’ products by a number or some other identification.
3. Cancellation of Lay-Buy by Buyer
   The buyer may cancel their LayBy agreement form at any time prior to delivery of products and on delivery of products if the products are damaged by so advising seller in writing or if seller agrees, orally.If a buyer cancels a Lay-Buy, seller will, if so requested by the seller, give the buyer a “cancellation statement” which sets out-
   a) The purchase price of the products; and
   b) Advise customer of the cancellation fee payable to seller under all Lay-By terms and conditions; and
   c) The total amount paid under the Lay-Buy; and
   d) Any amount owing to either the buyer or seller under the layby terms on the cancellation of the Lay-Buy.If seller does not accept the buyer’s oral cancellation it is obliged to give/send the buyer a duly completed Lay-By Form of Cancellation immediately.
4. Cancellation of Lay-Buy by Seller
   The seller under a Lay-Buy must not cancel it unless –
   a) The buyer breaches a term of the Lay-Buy; or
   b) The seller stops trading; or
   c) The products are no longer available
5. Cancellation on breach by Buyer
   If a buyer has breached a term of a Lay-Buy and seller intends to cancel the Lay-Buy, before doing so seller must –
   a) Give the buyer notice of seller’s intention to cancel the Lay-Buy; and
   b) Allow the buyer at least 14 days within which to rectify the breach; and
   c) The notice to be given has to be:I) in writing, sent to the buyer’s last known address, or, if the buyer so agrees, orally; and
   II) must specify the breach of the Lay-Buy for which the Lay-Buy is being cancelled; and
   III) must state the time within which the buyer must rectify the breach;
   IV) must state the matters listed per below:* the purchase price of the products;
   * all cancellation charges payable under the agreement; and
   * the total amount paid under the Lay-Buy;
   * any amount owing to either the buyer or seller under the terms of the Lay-Buy on the cancellation of the Lay-Buy.The Lay-Buy is cancelled at the end of the period specified in the notice unless the buyer rectifies the breach before then or Seller agrees not to cancel it.
6. Cancellation where business closes
   If Seller under a Lay-Buy agreement proposes to stop trading before the agreement is completed, Seller must give notice of the proposal to the buyer and must either –
   (a) allow the buyer 7 days within which to complete the agreement; and
   (b) cancel the Lay-Buy
7. Cancellation where products not available
   If the products are no longer available, Seller must cancel the Lay-Buy and refund all monies to the buyer.
8. Effect of Cancellation
   Subject to the above, when a Lay-Buy is cancelled by either party, Seller must refund all money paid within 14 days less a NZD $35 cancellation fee. There are circumstances which prohibit Seller from keeping the cancellation charge. These include but are not limited to, situations where the products are damaged or not delivered or where Seller has breached a term of the Lay-Buy statement.
9. Cancellation Charge
   Seller shall charge the buyer a NZD $35 cancellation fee under the terms of all Lay-Buy deals.
10. Banking Charges back Fees
    The seller shall be entitled to pass-on to the buyer all charge back fees received by any given bank for any given customer charge back from any given Lay-Buy deal.
11. Service Fee
    Seller shall not charge the customer any interest charges, membership fee or service fee on any Lay-Buy sales transaction. Lay-Buy Financial Solutions Pty Ltd trading as www.lay-buys.com charge an admin fee, which is a once-off 1.9% of the total order value at checkout. The buyer will pay this amount to Lay-Buys at checkout at time of paying the down payment. This fee is an admin fee and is therefore not refundable.
12. Lay-Buy Reporting
    Seller shall have reporting in place for all Lay-Buy deals covering Down Payment made, Lay-Buy period, Frequency of payments required, Payment amount required per installment; and a full record of all payments made to-date (amount and date on which made).
13. Delivery
    The seller will only dispatch the buyer product/s after receiving the final installment payment for all Lay-Buy deals.
14. MISCELLANEOUS
    14.1   This Agreement shall be binding upon, inure to the benefit of, and be enforceable by the representatives, successors and assigns of the parties hereto.
    14.2   This Agreement may be amended only by a written instrument duly executed by all parties hereto.
    14.3   The parties hereby represent and warrant that each of them has full legal right, power and authority to enter into this Agreement and to carry out its obligations hereunder.
    14.4   This Agreement may be executed simultaneously in one or more counterparts, each of which shall be deemed an original but all of which together shall constitute one and the same instrument.
    14.5   Article headings contained herein are for reference purposes only and shall not in any way affect the meaning or interpretation of this Agreement.

We do not have to give a refund if you change your mind about a purchase 

— so please choose carefully.

If the product you have bought is faulty, we will provide a remedy as required by the Consumer Guarantees Act.

The purchaser acknowledges that a sale can be conducted GST Inclusive or plus GST. The auctioneer will advise a sales GST status prior to the commencement of bidding. When applicable a GST amount of 15% (or whatever prescribed amount is in force by legislation) will be added to the bid price. Further, the purchaser acknowledges and agrees that in the absence of advice to the contrary, that all bids by the purchaser will be deemed to be inclusive of GST.

1. The purchaser acknowledges that all sales conducted by the auctioneer, that a buyer’s premium may be charged on the bid price.
2. As soon as practicable after the fall of the hammer the Purchaser shall sign the agreement (if any) for sale.
3. The Purchaser shall be deemed to purchase as principal unless prior to the sale -
   a) He/She shall have disclosed to the Auctioneer that he will be bidding on behalf of a principal and shall supply the full name and address of his principal; and
   b) He/She has given to the auctioneer a copy of written authority to bid for or on behalf of a person.
4. The Auctioneer and Vendor reserve the following rights which may be exercised by the Auctioneer without giving any reason therefore –
   a) To withdraw any lots from the sale;
   b) Not to offer for sale part only of any lot described in the catalogue;
   c) To offer two (2) or more of the lots described in the catalogue as separate lots for sale together as one lot;
   d) Should such lots referred to in (c) of this condition not be knocked down under the hammer to a successful bidder, to offer such lots as separate lots;
   e) To refuse to accept a bid or bids from any person or persons which in the opinion of the Auctioneer is not in the best interest of the Vendor;
   f) To refuse admission to/or eject from the selling place any person or persons;
   g) To refuse to accept any bid for a lot being less than a sum nominated from time to time by the Auctioneer;
   h) To keep secret the existence and amount of the reserve price (if any) of a lot prior to the close of bidding or withdrawal from sale of the lot;
   i) In the event that the Purchaser shall successfully bid for more than one lot at the auction;
   to appropriate any moneys received from that Purchaser in satisfaction or partial satisfaction of the purchase price (and any taxes, if applicable) due in respect of any one or more of such lots to the total of partial exclusion of amounts due in respect of any other such lot or lots as the Auctioneer shall see fit; and to elect at any time to treat each contract for the sale of each such lot as interdependent with each other such contract or contracts and default under any such contract shall be treated as default under all such contracts;
   j) to bid on behalf of any vendor, prospective Purchaser or Purchaser’s with or without disclosure; and
   k) in the event that any lot is not sold at the auction to offer to sell same thereafter by private treaty but otherwise subject to these conditions.
5. The Vendor or any person on his behalf reserves the right to bid at the auction in respect to any lot. The Vendor acknowledges that for any successful bids he/she shall still be liable for the payment of any relevant commissions.
6. Any bidder shall give his full name and residential address at the time of registering to bid or when called upon to do so by the Auctioneer.
   a) Prior to the end of the auction or at any time thereafter specified by the Auctioneer the Purchaser shall pay to Auctioneer the full price for the lot, plus any GST, license fee or any other government charge applicable to the goods.
   b) The Auctioneer at his discretion may not require immediate payment or part payment for a lot.
   c) The purchase price and, where applicable, any part payment thereof, and GST shall be paid in either cash, bank cheque, credit card or bank transfer
   d) Any balance of the purchase price for a lot shall be paid to the Auctioneer no later than the expiration of the period during which the Purchaser is required by the conditions to take delivery of the lot and he shall not be entitled to require delivery until the purchase price and, where applicable, GST, license fee or government charge shall have been paid in full; and
   e) Time shall be of the essence in relation to the interpretation and observance of these conditions.
   f) A 3% surcharge will apply to all credit card payments.
7. On the fall of the hammer, the Auctioneer may require and the Purchaser shall pay a cash deposit of twenty five per cent (25%) in part payment of the purchase price for the lots purchased by the Purchaser. In default, the lot or lots so purchased may at the absolute discretion of the Auctioneer be immediately re-offered for sale and re-sold.
8. No error or misdescription or deficiency in quantity shall void the sale and the purchaser shall be bound to take the delivery of the lot without any allowance or abatement in price. Any warranties which might otherwise be implied by the Sale of Goods Act, 1923, are hereby excluded and shall not apply. The auctioneer and the vendor make no warranties other then those implied by Common Law or by statute the exclusion of which warranty would render this condition void or voidable or which would constitute an offense by the auctioneer or the Vendor. Intending bidders must satisfy themselves by inspection or otherwise as to the nature of the lot or lots offered for sale and must accept same with all fault, patent or latent (if any). Furthermore, no warranty shall be implied from any affirmation made at the auction or otherwise but in all cases where an express warranty is intended, the same shall only be enforceable of reduced to writing and signed by the Vendor or by the Auctioneer as agent for the Vendor.
9. Each lot shall lie at the purchaser’s risk from the fall of the hammer and neither the auctioneer nor the vendor shall be accountable for any deficiency, damage or loss which may arise thereafter. The property in such lot shall not pass until payment in full of the purchase price and, where applicable, GST, license fee or government charge or until all cheques delivered on account of same have been honoured upon presentation for payment. Bidders must have satisfied themselves by inspection or otherwise as to the condition of the lot or lots sold. No matters will be entered into once lots are removed from the sale site.
10. No lot shall be removed during the sale without the consent of the auctioneer, but subject to condition 10 hereof, delivery is to be taken and the lot removed by the purchaser within one (1) full working day of the day of the auction or such other period of time as may be specified by the Auctioneer at the time of sale and, in this respect, time is of the essence. Any removal shall be at the expense and risk of the Purchaser but, in such removal, the Purchaser shall do no damage, or shall forthwith make good any damage, which may be occasioned. Any lot or part thereof which the Purchaser does not remove may thereafter be removed by the Auctioneer or by some person, firm or company engaged by the Auctioneer or the Vendor and/or stored at the place at which the auction took place or elsewhere by the Auctioneer or by some person, firm or company engaged by the Auctioneer. Such removal and/or storage shall be deemed to have been made by the Auctioneer at the request of the Purchaser and all costs incurred by the Auctioneer or the Vendor in relation thereto together with an amount of $5.00 plus GST per lot per day penalty shall be immediately payable by the purchaser to the Auctioneer and the Auctioneer may sue for and recover the same as liquidated damages.
11. If the purchaser shall default in the observance or performance of his obligation under these conditions or any one or more of the then any moneys which the purchaser shall have paid to the auctioneer shall be absolutely forfeited and, without notice to the Purchaser, such lot or lots may be re-sold either by public auction or private contract and upon such terms and conditions as either the Auctioneer or the Vendor shall deem fit at the risk and expense of the purchaser who shall be liable for any deficiency together with all expenses of removal, commission, warehousing and other charges arising out of such default and the auctioneer or the vendor shall be entitled to recover same as and for liquidated damages. Without limiting the generality of the foregoing, the Auctioneer shall be entitled to recover from the purchaser.
    a) the amount of any commission upon the purchase which the Purchaser did not complete, the commission being determined by the agreement between the parties
    b) such sum for expenses and charges incurred by the Auctioneer in connection with or incidental to the auction and in respect of any such re-sale; and
    c) where applicable, any GST, value added tax or any other tax relating to or arising from the sale of the property or any part thereof of the Vendor.
12. Furthermore, the purchaser shall take or cause to be taken all reasonable and proper steps so far as is reasonably practicable in order to ensure that, the lot or lots purchased shall be safe and without risks to health when properly used.
13. In these Conditions the word “Auctioneer” means All About Auctions except that where the context so permits it shall include the persons actually conducting the auction on behalf of All About Auctions Limited.
14. All goods are to be sold “as is where is” with no warranties or guarantees either expressed or implied unless otherwise stated in the product description
    Industrial Safety Warning
    The “Health & Safety in Employment Act 1992” and it’s regulations, impose obligations in respect of the safety for workers arising out of the DESIGN, MANUFACTURE AND SUPPLY of machinery for use in a work place.
15. All About Auctions warns buyers that all plant or equipment offered for sale at this auction may not be fit for use in a work place. It is the buyers or users responsibility to ensure that it is brought to a standard necessary to comply with the “Health & Safety in Employment Act 1992” it’s regulations, and it is safe and fit for use in the work place.
    Breaches of the “Health & Safety in Employment Act 1992” carry onerous penalties for people who purchase and operate UNSAFE EQUIPMENT, without conducting a thorough safety inspection. Plant must be given a safety inspection prior to operation when it is purchased at auction. In the interest of “Health & Safety” for workers, safety inspections of plant purchased at auction must be performed.
16. The Vendors of these goods are selling them "in trade" as suppliers (within the meaning of the Consumers Guarantees Act 1993).
